The purpose of this document is to establish the General Conditions of Use of the OldBCN Card! (hereinafter “the card”) ownership of OLD BCN, S.L. (hereinafter OLD BCN), with registered office at c / Hostal d'en Sol, 7, local, 08002 Barcelona, with tax identification number B66621368 and registered in the Mercantile Registry of Barcelona, Volume: 45018, Folio: 101, Sheet: 474425, Registration: 1, Date of Registration: October 14, 2015.

OLD BCN reserves the right to modify these General Conditions of Use in order to adapt them to the current legislation applicable at all times, the jurisprudential novelties and the usual market practices.

The use by the user of any of the services of the card implies and expresses its adhesion and express acceptance of all the General Conditions of Use in the version published on this website at the moment in which the user accesses the card.

Conditions of Access and Use of the card

The use of any card service attributes the User's condition thereof. The user acknowledges and accepts that the use of the contents and/or services offered by the card will be under his exclusive risk and / or responsibility.

The user undertakes to use the card and all its content and services in accordance with the provisions of the law, morals, public order and these General Conditions of Use. It also undertakes to make appropriate use of the services and/or contents of the card and not to use them to carry out illicit or criminal activities, that violate the rights of third parties and/or that infringe the regulation on intellectual and industrial property, or any other norms of the applicable legal system.

The user undertakes not to transmit, introduce, disseminate and make available to third parties, any type of material and information (contained data, messages, drawings, sound and image files, photographs, software, etc.) that are contrary to the law, morality, public order and these General Conditions of Use.

Intellectual and Industrial Property

The contents, elements and information to which the user can access through the card are subject to industrial and intellectual property rights, trademark patents, copyright of the cardholder or third party holders thereof. Consequently, access to these contents or elements does not grant the User the right to alter, modify, exploit, reproduce, distribute or publicly communicate or any other right that corresponds to the owner of the affected right.

The user agrees to use the contents and/or elements accessed through the services of the card for their own use and needs, and not to make any commercial exploitation, directly or indirectly, of them.

Liability and Exclusion of Guarantees

Availability and continuity of the card and services. OLD BCN does not guarantee the availability, access and continuity of the operation of the card and its services. OLD BCN will not be responsible, with the limits established in the current legal system, for the damages caused to the User as a consequence of the unavailability, access failures and lack of continuity of the card and its Services.

Contents and services of OLD BCN. OLD BCN will respond only and exclusively to the Services provided by itself and the contents directly originated by OLD BCN and identified with its copyright. Said liability shall be excluded in cases in which force majeure causes occur or in the cases in which the configuration of the User's equipment is not adequate to allow the correct use of the Internet services provided by OLD BCN.

Contents and services of Third Parties. OLD BCN does not previously control, approve or endorse the contents, services, opinions, communications, data, files, products and any kind of information of third parties, legal or physical persons, included in the offers, discounts and promotions of the card. Likewise, it does not guarantee the legality, reliability, usefulness, veracity, accuracy, completeness and timeliness of the content, information and services of third parties on the card. OLD BCN does not control beforehand and does not guarantee the absence of viruses and other elements in the contents and services provided by third parties through the card that may introduce alterations in the computer system, electronic documents or files of users OLD BCN will not be responsible, neither indirectly nor subsidiarily, for damages of any kind arising from the use and contracting of the Contents and Services of third parties on the card as well as the lack of legality, reliability, usefulness, accuracy, completeness and actuality of them. OLD BCN will not be responsible, indirectly or subsidiarily, for damages of any kind caused to the User as a consequence of the presence of viruses or other elements in the contents and Services provided by third parties that may produce alterations in the computer system, documents electronic or user files The exoneration of responsibility indicated in the preceding paragraphs will be applicable in the event that OLD BCN has no actual knowledge that the activity or information stored is lawful or that it damages property or rights of a susceptible third party of compensation, and if they had it, act with diligence to remove the data and contents or make it impossible to access them.

Conduct of Users

OLD BCN does not guarantee that the users of the card use the contents and/or services thereof in accordance with the law, morality, public order, or these General Conditions. Likewise, it does not guarantee the veracity and accuracy, completeness and/or authenticity of the data provided by the users. OLD BCN will not be liable, indirectly or subsidiarily, for damages of any kind arising from the use of the services and contents of the card by users or that may arise from the lack of veracity, accuracy and/or authenticity of the data or information provided by the users, or of the impersonation of a third party's identity made by a user in any kind of action through the card.

Conduct of Members

OLD BCN publishes on its web page the offers, discounts and promotions previously communicated to us by members associated with the ASSOCIACIÓ DE COMERÇ I TURISME DE CIUTAT VELLA. The user must benefit from the offers, discounts and promotions that are published on the web page of Oldbcn.com of each member.

The member, however, can modify its content at the time it seems appropriate by email to redaccionARROBAoldbcn.com 24 hours before the date of modification or cancellation of the offer. OLD BCN does not obtain any benefit, nor commission for the use of the card, it is simply a platform for members to make offers, discounts or promotions to the visitors of the district.

Duration and Termination / Law and Jurisdictional Jurisdiction

The provision of services and/or contents of the card has an indefinite duration. Notwithstanding the foregoing, OLD BCN is entitled to terminate, suspend or interrupt unilaterally, at any time and without notice, the provision of the service and the card and/or any of the services.

All matters relating to the card are governed by the laws of Spain and are subject to the jurisdiction of the competent courts and tribunals of Barcelona.
